Ok, we've been talking about this Vendo 81 B that Myself and Collecture where bidding on and I won, that spawned the thread about user id's and such... SO get this...

I won the auction, Conctacted the seller letting them know I'd pick it up and pay cash instead of the paypal invoice they sent me.

I get an email from the seller, this guy from Kyles collectables in Iowa, saying to contact the owner as he was selling it for her, turns out the lady that I've spoke with last week about the machine and condition, parts, etc..

I contacted the lady this morning via phone and introduce myself as the winnng bidder and would like to come get it tomorrow or Wednesday. She says, that there has been a problem and the machine is not available !!!! I said what... I won the auction, you have contractually through Ebay committed to sell it to me.. She goes on about some family squable over the weekend over her fathers estate and one of the other kids wants to buy the machine?  I again repeated that I, through Ebay's eyes am entitled to the machine, she said Not sure what will happen and takes my name and number... I'm fearious.... and email the guy who was listing it and told him to look into this and get it resolved as he is the one who will get the negative feedback from me in the event this all goes sour!... THoughts??? Suggestions???

I'm Really sorry to here That

I had a problem like it once .Bought a  100th Anniversary Mirror from Coke .From the seller Sent money Postal money order NEVER received anthing No E-mails back .Went threw E-bay Waited 1 month then e-bay has responce from seller Refund sent I nrver received it .I went back to e-bay & aited another month E-bay reply Well refund you amount for a $20,Dollor fee , I only paided $44.00  So after really 3 months of fighting I gave up .

Just heard back from the person who listed it for her, and he too was concerned as he is out his 20% i guess he contracted with her to sell off an estate of stuff... he is telling her it's her obligation to give up the item, and apparently she has an estate lawyer who granted her permission to sell the stuff. Turns out the "Family Members" who are opposing the sale, are Adopted siblings so hopefully the lawyer will back them off.?? Fingers crossed... luckily however I have sent no money!!!  I'll keep you updated... '<img'>  '<img'>

Her family probably  thinks it's worth a fortune cause

As far as I see it, she doesn't have to sell you anything since no money has changed hands. Even if you did send money she can just send it back. Believe me you don't want to get in the middle of a nasty estate dipute.

We'll aside form Cormy's advice I did stay in touch with the seller and the guy who listed it for her and pushed my point that a ebay listing is a contract to sell and it's MINE!... She checked with her legal representative and after 2 weeks of fighting with her siblings, lawyer who gave her the right to sell her fathers things, went to a judge who declared the stuff was hers to sell!!!!!!! '<img'>  '<img'>
So got a call from her today that I can come pick up the machine and will doing so on Wednesday Morning!!!... then of course she tells me that it's downstairs and will need some help getting it out... so this will be interesting... but more to come on Wednesday!... So far soo good! '<img'>

Oh Yes... every time I'm looking for "Stuff" especially in houses... I always have the eyes open as most of the time there is some little suprise sitting in the corner... Plus it is an estate of her fathers and it hasn't been sold yet... so we'll be bringing a little extra Moola if I find something!!! Pictures will be taken and shared on Wednesday evening...

Glad you got the machine.

I am adopted and an Adopted child  is no different than biological children in the eyes of the law. There are 4 of us.

My step brorthers tried to play this card on my fathers estate and the judge laughed at them and ordered them to leave the court room.

We ended up with the house they got the contents. So even if we are adopted we are not second class.
I'm a college graduate, former banker and served my time in the US air force.

I was not intending to persecute the adopted Siblings, only to share with you the fact that the lady selling the items did not even know she had adopted siblings nor did the estate lawyer or courts, until I guess they caught wind that the the father had passed away (obviously they where not real close to the family), then they came running trying to get there hands on everything... however they worked it out and I get the cooler... I'm leaving at 6am tomorrow morning....  '<img'>

Usually, if an estate has to file probate, ALL immediate relatives -
sisters, brothers, half-sisters, half-brothers, etc will get a notice of probate and can contest it.
If the will undeniably states who gets what and an estranged sibling cannot prove otherwise,
they are usually out of luck.

No offense taken, I still get miffed when the law isnt understood on adoption,
like what my steps tried to do. And what I still hear to this day.

From my adoption papers. "said child/children shall inherit from and through the adopting parents to the same extent and under the same conditions as provided for the inheritence between brothers and sisters of full blood as under the laws of descent and distrubution, and that hereafter, the adopting parents, and other children, if any, including other adopted children.
Shall in hereit from said child/children the same as if said child/children had been born to the adopting parents including all rights existing by virtue of state code shall NOT inherit from natural parents from which parental rights have been terminated through adoption.

Well made it back with the 81b this afternoon, and have to say I'm quite happy with it. Had to battle and ice storm this afternoon on my way back but maybe the extra weight in the back helped keep the truck on the road.
I know everyone loves story so I'll tell how it went down, as it's been kinda dramatic up till this point. We all know now that there was a 3.5 week delay on me getting an answer on this as to if It was going to be mine or not. Some family members where making claims on stuff, without the seller knowing it. it got into a big legal mess, but since the seller was selling her fathers stuff to clear up bills for her fathers estate, she was entitled to sell stuff to offset bills.. Anyway... thats the boring part.
I get to the house and she had told me it was down 6 steps, so I had brought my fridge dolly with me. turns it it was 6 one way and then a turn and 6 more! but luckily here husband was there and helped me get the cooler out. It's a nice straight and complete Vendo 81b. Had some paint job redo on it at some point a while ago, One of thos paint jobs where they just tape off the chrome and then spray the whole dang thing, see photos) but other than that the whole machine is complete, runs,and vends. Looks fairly clean, had to drill out the lock as she had lost the key, but had everything inside. Overall I'm very happy with it for the price I paid and will be another fun project as this will be my 3rd 81 I will have worked on. I also got home and found my package containing my Dole Citation Fountain dispenser that looks pretty nice too... SO IT's been a good Day.. Merry Christmas to me!!!

I am suprised they took the time to take the coin entry bezel off.
They didn't even remove the coin box or cap catcher!
Oh well, it will restore nicely.

Thanks, I'm pretty pumped to get working on it.. so now I have a few winter/spring and possibley summer projects as it will take me that long to get going... sucks not having a heated garage or shop to work on and the wife won't let me haul this into the basement to work on.
Now I have the Vendo 81 and the Bennett 1066 Gas Pump to do as well, then and overhaul retune on my 59 vette this spring.
