Just o I need to use heat on it?  I can not get any pics to load on here if you need pics of the part i am talking about I can email them to you.  Thanks in advance.

Have you tried PB Blaster? It works great to free rusted parts to loosen them up. You should be able to get it at any auto parts store.

A combo of heat and PB blaster usually does it for me

Darn tried it and the bolt just broke off so I guess i'm doing the drilling out now.. lol
